LEGAL NOTICE: By using the website www.ortegalmaxico.com (hereinafter, "Ortegal Máxico") and accessing its content, you agree to abide by these Terms and Conditions of Use. Please read these terms carefully, as they govern the use of all images published on Ortegal Máxico. If you do not agree, we request that you refrain from using the site and the images available on it.

INTELLECTUAL PROPERTY RIGHTS

All images published on Ortegal Máxico are protected by intellectual property rights as recognized and safeguarded by Spanish Intellectual Property Law, approved by Royal Legislative Decree 1/1996, and other applicable laws. Copyright ownership belongs exclusively to the respective authors of each image, who retain all rights over their works, including, but not limited to, the rights of reproduction, distribution, and public communication.

2.USAGE LICENSES

Ortegal Máxico grants different types of licenses for the use of its images, which are detailed below:

2.1 Dissemination License

A Dissemination License is granted exclusively for educational, informative, or documentary purposes, provided that the following conditions are met:

• The images must include a direct link to the original publication on Ortegal Máxico.

• Proper attribution must be given to the image's author, including their name in the publication or medium where the image is used.

Any failure to meet these conditions invalidates the license granted and will be considered unauthorized use.

2.2 Personal Use License

Ortegal Máxico offers a Personal Use License, allowing the Buyer to use the image exclusively for personal purposes, such as publications on personal blogs and social media, under the following conditions:

• Permitted Use: The Buyer may use the image solely for personal, non-commercial purposes. This license does not allow for the distribution, sale, printing, or any type of commercial use of the image.

Failure to comply with these conditions will invalidate the license and will be considered unauthorized use, subject to corresponding sanctions and liabilities. This license does not transfer ownership of copyright or exclusivity over the image.

2.3 Commercial Use License

The use of images for commercial purposes (including but not limited to printing, sales, advertising, or any other commercial or exploitative use) is strictly regulated. To obtain a commercial use license, it is necessary to:

• Request and obtain a specific license through Ortegal Máxico before using the images for these purposes.

• Pay the corresponding license fee based on the proposed use.

Failure to comply with this policy will be considered unauthorized use and may result in legal penalties. This license does not transfer copyright ownership or exclusivity over the image.

3.GENERAL CONDITIONS REGARDING LICENSES AND COPYRIGHT OWNERSHIP

Both Personal and Commercial Use Licenses do not transfer copyright ownership to the Client. The copyright ownership of all images remains with their respective authors, who retain all intellectual property rights.

3.1 Exclusivity License:

To obtain exclusive ownership of an image, the Buyer must acquire an Exclusivity License. This license allows the transfer of all rights over the image to the Buyer, granting them exclusive rights to its use and exploitation, with the author waiving any subsequent rights over the image.

4.PROHIBITIONS AND LIABILITY FOR UNAUTHORIZED USE

4.1 UNAUTHORIZED USE:

UNAUTHORIZED USE of images constitutes an infringement of intellectual property rights and may lead to legal liability, including claims for damages and civil or criminal penalties, as stipulated by Spanish/European Intellectual Property Laws.

Any unauthorized use of images available on Ortegal Máxico is strictly prohibited. This includes, but is not limited to:

• Reproduction, printing, sale, or distribution of images, whether in physical or digital media, without previously obtaining the corresponding license.

• Use in commercial, promotional, or advertising campaigns without the proper license.

• Public display or any type of commercial exploitation without written authorization from the author.

4.2 Serious Unauthorized Use:

Serious Unauthorized Use includes, even having a license, using images in contexts or for purposes that infringe upon human rights or promote discrimination, xenophobia, incitement to hatred, or public disorder. Ortegal Máxico will report any serious violations to the appropriate authorities, subjecting the violator to possible civil and/or criminal penalties.

5.LIABILITY DISCLAIMER

Ortegal Máxico and the image authors shall not be held responsible, under any circumstances, for damages, losses, or legal liabilities arising from the unauthorized use of images. Users of Ortegal Máxico are solely responsible for ensuring that they have the appropriate licenses and permissions for the use of any image.

Ortegal Máxico reserves the right to update or modify these Terms and Conditions at any time, and users are advised to periodically review this document to ensure they are informed of the current terms.
